Welcome to Happytooth. These Terms of Service ("Terms") govern your access to and use of the Happytooth mobile application ("App") and website ("Website"). By downloading, installing, or using the App, or by accessing the Website, you agree to be bound by these Terms.

Important: If you do not agree to these Terms, please do not use the App or Website.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Happytooth ("we," "us," or "our").

2. License to Use

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your Android device
  • Use the App for your personal, non-commercial purposes
  • Access the Website for information about the App

2.2 Restrictions

You agree NOT to:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or distribute the App
  • Use the App for any illegal or unauthorized purpose
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App to damage, interfere with, or disrupt other users' devices
  • Attempt to gain unauthorized access to the App's code or systems

3. User Responsibilities

3.1 Device Compatibility

You are responsible for:

  • Ensuring your device meets the App's minimum requirements (Android 8.0+)
  • Maintaining your device's operating system and security updates
  • Having a compatible Bluetooth-enabled device

3.2 Bluetooth Device Management

When using the App to manage Bluetooth devices, you acknowledge that:

  • You have the right to connect to and manage the Bluetooth devices
  • You are responsible for properly pairing devices before using the App
  • Connection success depends on device compatibility and Bluetooth standards
  • The App cannot guarantee connections will always succeed

3.3 Data Backup

You are responsible for backing up your device. While the App stores data locally, device failures, factory resets, or app uninstallation will result in data loss.

4. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the App will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of information
  • Warranties that defects will be corrected

We do not warrant that:

  • The App will meet your specific requirements
  • Bluetooth connections will always be successful
  • The App will be compatible with all devices or Bluetooth profiles
  • The App will work with future Android versions or device updates

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

  • Direct, indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Device malfunction or damage
  • Failed Bluetooth connections or device incompatibility
  • Errors, bugs, or interruptions in the App
  • Loss of use of any device or service

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

6. Privacy and Data Collection

Your use of the App is also governed by our Privacy Policy. Key points:

  • No Data Collection: We do not collect, store, or transmit your personal data
  • Local Storage: All data is stored locally on your device
  • No Tracking: We do not use analytics, advertising, or tracking services
  • Permissions: Bluetooth and location permissions are required for functionality

By using the App, you consent to the data practices described in our Privacy Policy.

7. Updates and Modifications

7.1 App Updates

We may, from time to time:

  • Release updates, upgrades, or modifications to the App
  • Add, remove, or change features and functionality
  • Discontinue support for older Android versions

You are not obligated to install updates, but older versions may not function correctly.

7.2 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date
  • Significant changes will be announced in the App or on the Website
  • Your continued use after changes constitutes acceptance of the new Terms

If you do not agree to the modified Terms, you must stop using the App.

8. Termination

8.1 Termination by You

You may terminate this agreement at any time by:

  • Uninstalling the App from your device
  • Ceasing to use the App and Website

8.2 Termination by Us

We may terminate or suspend your access to the App at any time, without notice, if:

  • You violate these Terms
  • You use the App for illegal purposes
  • We discontinue the App or Website

8.3 Effect of Termination

Upon termination:

  • Your license to use the App immediately ends
  • You must uninstall the App from all devices
  • Sections regarding disclaimers, limitations of liability, and dispute resolution continue to apply

9. Intellectual Property

The App, Website, and all content, features, and functionality are owned by Happytooth and are protected by:

  • Copyright laws
  • Trademark laws
  • Other intellectual property rights

Trademarks: "Happytooth," the Happytooth logo, and other marks are trademarks of Happytooth. You may not use these marks without our prior written permission.

Third-Party Content: The App may include third-party libraries or components that are subject to separate licenses.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

10.2 Dispute Resolution

In the event of any dispute arising from these Terms:

  1. Informal Resolution: Contact us at support@gethappytooth.com to attempt to resolve the dispute informally
  2. Formal Dispute: If informal resolution fails, disputes will be resolved through arbitration or in the courts of your jurisdiction, as applicable

11. Indemnification

You agree to indemnify, defend, and hold harmless Happytooth, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your violation of any applicable laws or regulations

12. Third-Party Services and Devices

The App interfaces with:

  • Android Operating System: Subject to Google's terms and policies
  • Google Play Store: Subject to Google Play's terms of service
  • Bluetooth Devices: Manufactured by third parties with their own terms

We are not responsible for:

  • Third-party device compatibility or functionality
  • Third-party terms of service or privacy policies
  • Bluetooth standard implementations by device manufacturers
  • Changes to Android or Google Play Services

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Happytooth regarding the App.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

13.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship.

13.6 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, acts of government, or network failures.
